What the PoSH Act asks of every employer

The Act applies to every workplace in India, whatever its size. These are the duties that fall on you as the employer.

1

Constitute an Internal Committee

At every office or unit with 10 or more employees, led by a senior woman employee, with at least half its members women and one member from outside.

2

Adopt and publish a policy

A written policy that defines sexual harassment, explains how to complain and sets out the consequences.

3

Display the essentials

The penal consequences of sexual harassment and the order constituting your committee, somewhere everyone can see them.

4

Run awareness programmes

Workshops for employees at regular intervals, and orientation for the members of your committee.

5

Support the committee

Give it the facilities it needs, and help secure the attendance of the respondent and witnesses.

6

Act on its findings

Act on the committee’s recommendations within 60 days, and treat sexual harassment as misconduct under your service rules.

7

Protect confidentiality

The identities of the people involved and the details of an inquiry can’t be made public. Breaches can be penalised.

8

Report every year

The committee files an annual report with you and the District Officer, and you disclose the number of cases in your own annual report.

Who the Act protects

Any woman at your workplace, whether she is an employee, intern, contractor, consultant, client or visitor. A workplace includes anywhere visited in the course of work, including transport you provide. Workplaces with fewer than 10 employees are covered by the district’s Local Committee.

[02]Services

Compliance that people trust

Pick one service or let us run the whole programme. Every engagement starts with a free health check.

Policy & Internal Committee setup

A policy people can actually read, and a committee that is set up correctly from day one.

  • A new or refreshed policy in plain English and Hindi
  • Committee composition checked office by office
  • Committee orders, notices and posters ready to display
  • Confidential ways to raise a concern, online and offline

Ready in two to three weeks for most organisations

External member service

The Act asks for one committee member from outside your organisation. We match you with an experienced practitioner who brings an independent view.

  • Members with legal or social-work backgrounds
  • Matched to your location and working language
  • Available for meetings and hearings, in person or online
  • A conflict-of-interest check before every case

For a term of up to three years, as the Act allows

Employee awareness programmes

Practical sessions that help people recognise sexual harassment, respond to it and know exactly where to go.

  • What counts as harassment, including online and off-site
  • How to raise a concern and what happens next
  • What bystanders and managers should do
  • Attendance records for your compliance file

45-minute e-learning, 2-hour live session or manager module

Internal Committee training

Committee members have powers similar to a civil court. We prepare them to run inquiries that are fair, sensitive and finished on time.

  • Their powers and duties under the Act and Rules
  • Natural justice, and how to keep bias out
  • Hearings, evidence and a reasoned final report
  • A mock inquiry, from complaint to recommendation

One-day or two-day workshop, with yearly refreshers

Inquiry support

When a complaint comes in, your committee is never on its own. We guide the process; the committee decides.

  • Each step and deadline tracked for the committee
  • Notices, summons and minutes drafted for review
  • Advice on interim relief, such as a transfer or leave
  • Help structuring the final inquiry report

On call for the life of each case

Compliance audit & annual report

Find the gaps before anyone else does, and file every report on time.

  • A gap check against the Act and Rules, office by office
  • The committee’s annual report to you and the District Officer
  • Case numbers for your own annual or board report
  • A yearly plan for training and refreshers

Once a year, or before an audit or due-diligence review
